(Southern Legal Resource Center) – Defend Arlington announces today that it has requested the American Council on Historic Preservation (“ACHP”) to intervene in the regulatory review process being conducted by the U.S. Army in the planned removal of the Reconciliation Memorial from the Arlington National Cemetery Historic District.

Beginning in August, the US Army announced it would commence a Section 106 review process under the National Historic Preservation Act, which governs potential damage to historic resources in National Register Historic Districts. Since that time, Defend Arlington asserts that the Army National Military Cemeteries (“ANMC”) have violated numerous regulations in their review process and asked the ACHP to intervene. A letter sent to Reid Nelson, Executive Director of ACHP by Defend Arlington on Wednesday cites six regulations the ANMC has not adhered to during the process. Mr. Reid has acknowledged receipt of the letter but has not responded to the concerns raised.

If the ACHP does not intervene to ensure the regulations are followed, Defend Arlington will expand its pending litigation to include the cited regulatory failures in an effort to ensure the proper process is followed.

Defend Arlington is a coalition of pro-historic preservation groups that provide information and education about Historic Arlington National Cemetery and the endangered Reconciliation Memorial and are working to preserve it.
